EU-Compliant Return Policy for Perishable Goods


EXCLUSION FROM RIGHT OF WITHDRAWAL

In accordance with Article 16(e) of the EU Consumer Rights Directive 2011/83/EU, beverages are classified as perishable goods and are therefore EXCLUDED from the 14-day right of withdrawal.

You CANNOT return our products simply because you changed your mind.

This exclusion applies to all our products:

  • ✓ Functional drinks (Akvile Beauty Water, Digestif Water, Pre+Post Green Tea, VOSS Plus)
  • ✓ Flavored sparkling waters (Akvile Lemon, Tahiti Lime, Peach, Red Berry, Orange)
  • ✓ Flavored still waters (VOSS Strawberry Ginger, Lime Mint, Lemon Cucumber)
  • ✓ Premium botanical waters (Josephine Lemon & Rose, Mirabelle Plum & Cinnamon, Blueberry & Linden)
  • ✓ Any other product listed or not.

✅ WHEN WE ACCEPT RETURNS

We accept returns ONLY in the following cases:

1. DEFECTIVE OR DAMAGED PRODUCTS

Conditions:

  • Product received damaged (broken bottle, leaking, crushed packaging, etc.)
  • Product defective (altered taste, visible contamination, expired, incorrect seal, etc.)

Your obligations:

  • Report within: 48 hours after delivery
  • Required proof: Clear photos showing:
    • The damaged/defective product
    • Original packaging
    • Shipping label (if relevant)
    • Expiry date visible

Our solution:

  • Full replacement (same product sent again) OR
  • Full refund including original shipping costs
  • We cover return shipping costs

2. WRONG PRODUCT DELIVERED

Conditions:

  • You received a different product than ordered
  • Incorrect quantity delivered
  • Missing items from your order

Your obligations:

  • Report within: 48 hours after delivery
  • Required proof: Photos showing:
    • Product received
    • Delivery note/packing slip
    • Order confirmation email

Our solution:

  • We send the correct product immediately (expedited shipping)
  • You keep the wrong product OR we arrange return pickup (free)
  • Refund of any price difference if applicable

  3. Attach photos and your order confirmation

3. SIGNIFICANT DELIVERY DELAYS

Conditions:

  • Your order is delayed more than 10 business days beyond the estimated delivery date
  • You no longer need the products due to our delay

Your obligations:

  • Contact us first before refusing delivery
  • Provide your order number and delivery tracking

Our solution:

  • Option 1: Wait for delivery + receive 20% discount code for next order
  • Option 2: Cancel order + full refund (if package not yet dispatched)
  • Option 3: Partial refund + keep products (if package in transit)

❌ WHEN WE DO NOT ACCEPT RETURNS

We CANNOT accept returns in the following situations:

Not Eligible for Return:

  • ✗ "I changed my mind" / "I don't want it anymore"
  • ✗ "I found it cheaper elsewhere"
  • ✗ "I ordered the wrong product" (your mistake, not ours)
  • ✗ "I don't like the taste" (this is subjective and not a defect)
  • ✗ Products past the return notification deadline (48 hours)
  • ✗ Products opened and partially consumed (unless defective)
  • ✗ Products damaged due to improper storage by customer
  • ✗ Products without proof of purchase

⚠️ Legal basis: Article 16(e) of Directive 2011/83/EU explicitly excludes perishable goods from withdrawal rights.


REFUND PROCESS

Timeline:

  1. Report issue: Within 48h of delivery
  2. Our review: Within 24 hours of your email
  3. Approval: We send you return instructions (if applicable)
  4. Refund issued: Within 5-7 business days after approval

Refund method:

  • Same payment method used for purchase
  • If paid by credit/debit card: refund to that card
  • If paid by PayPal: refund to your PayPal account
  • Bank transfer (only if other methods unavailable)

What is refunded:

  • ✓ Product price
  • ✓ Original shipping costs (if product defective/wrong)
  • ✗ Return shipping costs (only if product defective/wrong - we cover them)

RETURN SHIPPING INSTRUCTIONS

For Defective/Wrong Products:

  1. DO NOT return before contacting us
  2. We send you a pre-paid return label (no cost for you)
  3. Pack product securely in original packaging
  4. Attach return label
  5. Drop off at designated carrier point
  6. Send us tracking number

Important:

  • Never refuse delivery without contacting us first
  • Products returned without authorization may not be refunded
  • Keep all original packaging until issue is resolved

YOUR RIGHTS UNDER EU LAW

Legal Guarantee of Conformity (Directive 1999/44/EC):

You benefit from a 2-year legal guarantee for conformity defects existing at time of delivery:

Within 6 months of delivery:

  • Defects are presumed to exist at time of delivery
  • We must prove the product was conform

After 6 months of delivery:

  • You must prove the defect existed at delivery time
  • Manufacturer guarantees may apply

This applies to:

  • Products not matching description
  • Products unfit for normal use
  • Products lacking expected quality/performance
