1. Scope

These Terms and Conditions of Sale (T&C) govern the contractual relationship between Aqua Architect Advisory Tallinn OÜ, hereinafter referred to as "the Seller", and any natural or legal person wishing to make a purchase on the nobullshitdrinks.com website, hereinafter referred to as "the Customer" or "the Buyer".

Any order placed on the website implies the Customer's unreserved acceptance of these T&C. These T&C prevail over any other document, except express written waiver.

2. Products

2.1 Product Description

The products offered for sale on nobullshitdrinks.com are premium functional drinks and flavored waters from European manufacturers (Akvile, Voss, Josephine, etc.).

Product descriptions, photographs, and characteristics are provided for informational purposes and may vary slightly. The Seller strives to present products as accurately as possible.

2.2 Availability

Product offers are valid subject to availability. In case of unavailability of a product after order placement, the Customer will be informed as soon as possible. The Customer may then choose a replacement product or cancel the order with full refund.

3. Prices

3.1 Product Prices

Product prices are indicated in euros (EUR) including all taxes (VAT included), based on the VAT rate applicable on the order date. Prices may vary depending on the delivery country.

The Seller reserves the right to modify prices at any time. However, products will be invoiced based on the rates in effect at the time of order validation.

3.2 Shipping Costs

Shipping costs are calculated based on weight, volume, and destination of the order. These costs are clearly indicated before final order validation.

Free shipping: From a certain order amount (variable by country), shipping may be offered. The free shipping threshold is indicated on the website.

4. Orders

4.1 Order Process

To place an order, the Customer must:

  1. Select desired products and add them to the cart
  2. Review cart contents and proceed to payment
  3. Provide delivery and billing information
  4. Choose delivery and payment method
  5. Accept these T&C
  6. Confirm and validate the order

4.2 Order Confirmation

Once the order is validated, the Customer receives a confirmation email summarizing order details, total amount, delivery address, and estimated delivery time.

The contract is considered definitively concluded upon the Customer's receipt of this confirmation email.

4.3 Modification or Cancellation

Any request to modify or cancel an order must be made as soon as possible by email to contact@nobullshitdrinks.com.

If the order has not yet been shipped, the Seller will do its best to accommodate the request. Once the order is shipped, only the withdrawal conditions (art. 7) apply.

5. Payment

5.1 Accepted Payment Methods

Payment for orders can be made by:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Apple Pay / Google Pay
  • Bank transfer (for B2B orders only, by quote)

5.2 Payment Security

Credit card payments are secured via PCI-DSS compliant payment solutions. The Seller does not store any banking data.

5.3 Immediate Payment

Payment is due immediately upon order. In case of refusal or payment default, the order will be automatically canceled.

6. Delivery

6.1 Delivery Zones

The Seller delivers to the following European Union countries: France, Belgium, United Kingdom, Italy, Spain, Portugal, Germany, Netherlands, Luxembourg and other countries upon request.

6.2 Delivery Times

Delivery times are indicated for information purposes when ordering. The Seller strives to meet these deadlines, generally:

  • 3 to 7 business days for deliveries in continental Europe
  • 5 to 10 business days for deliveries to the United Kingdom and peripheral areas

In case of delivery delay exceeding 30 days, the Customer may cancel the order and obtain a full refund.

6.3 Order Reception

Upon receipt of the package, the Customer must check the condition of the packaging and products. Any anomaly (damaged package, missing or broken products) must be reported immediately to the carrier and the Seller by email to contact@nobullshitdrinks.com, accompanied by photos.

The Customer has 48 hours after receipt to report any delivery-related issues.

7. Right of Withdrawal

7.1 Withdrawal Period (B2C only)

In accordance with European Directive 2011/83/EU on consumer rights, consumer Customers have a period of 14 calendar days from receipt of the package to exercise their right of withdrawal, without having to justify any reason.

7.2 How to Exercise Withdrawal

To exercise the right of withdrawal, the Customer must inform the Seller by email to contact@nobullshitdrinks.com of their decision to withdraw, before returning the products.

7.3 Product Return Conditions

Returned products must be:

  • In their original condition and packaging
  • Unopened and unused
  • Complete (all accessories, labels, instructions)
Important: Perishable products (functional drinks, flavored waters) cannot be returned once opened for health and safety reasons.

7.4 Return Costs

Return shipping costs are the Customer's responsibility, except in case of defective or non-conforming product.

7.5 Refund

Upon receipt and verification of returned products, the Seller will refund the full amount paid (excluding initial shipping costs) within 14 days maximum, using the same payment method as the initial order.

8. Warranties

8.1 Legal Warranty of Conformity

The Seller is bound by the legal warranty of conformity provided for in Articles L217-4 to L217-14 of the French Consumer Code (applicable across the EU).

In case of non-conformity, the Customer may return the product for exchange or refund, at the Seller's expense.

8.2 Legal Warranty Against Hidden Defects

The Seller is also bound by the legal warranty against hidden defects. In case of hidden defect, the Customer may return the product and obtain a refund or price reduction.

9. Liability

The Seller's liability is limited to direct damages proven by the Customer. The Seller cannot be held responsible for indirect damages such as loss of profit, business interruption, or data loss.

10. Personal Data

Personal data collected during the order is processed in accordance with our Privacy Policy and applicable GDPR regulations.

11. Applicable Law and Jurisdiction

These T&C are governed by Estonian law and European Union law.
